I. Introduction:
When using the services provided by Imotion, it is necessary to collect your personal data. This document demonstrates Imotion’s commitment to complying with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 – General Data Protection Regulation (“GDPR”), as well as other applicable legislation, including the national legislation complementing the GDPR (“Law 58/2019 of 8 August”).

All references in this document to “Imotion” refer to the company GER IMOTION, LDA., a legal entity with registration number 507 839 820, registered at the Commercial Registry Office of Cascais under the same number, headquartered at Rua Armando Cortez, No. 1, 1st Floor A, 2770-233 Paço de Arcos, Portugal, with a share capital of €5,000.00 (five thousand euros).
Imotion is the Data Controller for the personal data of various categories of data subjects, namely its clients and employees. As the Data Controller, Imotion determines which data is collected, the methods of processing, and the purposes for which the data is processed (“Data Controller”).

III. Personal Data We Collect:
Imotion collects personal data strictly in compliance with applicable legislation. The personal data collected by Imotion may come from various sources, and the following personal data may be collected:

–  Gender.
Imotion collects only categories of personal data related to identification, contact details, and biographical data provided by the Data Subjects.
The collection of personal data through our website uses cookies, which may collect personal data such as the pages visited and user preferences.
 
IV. What Are the Rights of Personal Data Subjects:
Imotion ensures all the rights provided under the GDPR to personal data subjects, including:
 
Right of Access to Data
The Data Subject has the right to obtain confirmation from the Data Controller as to whether or not their personal data is being processed and, if so, the right to access their personal data.
 
Right to Rectification
The Data Subject has the right to have inaccurate personal data concerning them rectified. Considering the purposes of the processing, the Data Subject also has the right to have incomplete personal data completed, including through providing an additional statement.
 
Right to Erasure
Data Subjects have the right to request the erasure of their personal data held by Imotion, provided there are no valid grounds for its retention (e.g., compliance with a legal obligation, defense of Imotion or third parties in a legal proceeding).
 
Right to Restriction of Processing
The Data Subject has the right to request the restriction of data processing by the Data Controller if one of the following applies:
(i) The accuracy of the personal data is contested by the Data Subject, for a period enabling the Data Controller to verify its accuracy;
(ii) The processing is unlawful, and the Data Subject opposes the erasure of their personal data and instead requests the restriction of its use;
(iii) The Data Controller no longer needs the personal data for processing purposes, but the data is required by the Data Subject for the establishment, exercise, or defense of legal claims;
(iv) The Data Subject has objected to the processing pursuant to Article 21(1) of the GDPR, pending verification of whether the legitimate grounds of the Data Controller override those of the Data Subject.
 
Right to Data Portability
The Data Subject has the right to receive the personal data concerning them, which they have provided to the Data Controller, and the right to transmit that data to another Data Controller without hindrance from the original Data Controller, except in cases where legally permissible exceptions apply.
 
Right to Object
The Data Subject has the right to object at any time, for reasons related to their particular situation, to the processing of their personal data, provided they are legally entitled to exercise this right.
 
Right to Withdraw Consent
Data Subjects have the right to withdraw the consent they have given for data processing based on that consent.
 
Right to File a Complaint with the CNPD
Data Subjects have the right to file complaints with the CNPD regarding matters related to the exercise of their rights and the protection of their personal data.
 
To exercise these rights, the Data Subject should contact Imotion via email or by registered letter with acknowledgment of receipt. Imotion is committed to making the necessary and reasonable efforts to ensure that Data Subjects can exercise their rights quickly and effectively.
 
V. Legal Basis for the Processing of Personal Data and Purpose of Data Processing:
Imotion processes personal data only when prior, explicit consent has been obtained—whether in writing, orally, or through any other informed, explicit, and free action for the specific purposes of the Data Subject.
The collection of personal data, particularly through Imotion’s website, primarily aims to allow Clients and other users accessing the website to contact Imotion. However, the data collected by Imotion may also serve purposes such as conducting marketing campaigns or promoting the brand, executing a contract with the Data Subject, fulfilling a legal obligation (e.g., transmitting the Data Subject’s information to national authorities such as the Tax Authority or Social Security), as well as Imotion’s legitimate interests, such as for the purpose of receiving applications and storing such data to communicate future job or service opportunities or other projects.
 
VI. How Long Personal Data is Retained:
Imotion retains personal data only for the minimum time necessary and for the period strictly required to fulfill the purpose for which it was collected or until the right to object or delete is exercised. Once this retention period has elapsed, Imotion will delete the personal data.
 
VII. With Whom We May Share Your Personal Data:
Imotion may disclose personal data to entities providing services, particularly in fulfilling its contractually stipulated obligations and services provided to its Clients. Imotion may also transmit personal data to legally authorized authorities when required for legal compliance. In no case does Imotion share personal data with other companies or brands for commercial purposes.
 
VIII. Security Measures:
In compliance with applicable personal data protection legislation, Imotion, acting as the Data Controller, is obligated to ensure adherence to all provisions of the GDPR regarding personal data processing under its responsibility, acting in strict compliance with the legal principles outlined in Article 5 of the GDPR.
In particular, Imotion ensures that data processing is lawful, fair, and transparent and that the personal data processed is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.
Imotion has implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk and to protect the legally protected rights and interests of data subjects.
 
IX. Changes to the Privacy Policy:
Imotion reserves the right to change this Privacy Policy at any time.
